About these terms
These Website Terms & Conditions apply to purchases made directly by consumers through the Aston Lucas Gourmet online store (the Website). They do not govern orders placed through Cookaborough for NDIS customers or through the Msales app for wholesale customers.
By using the Website or placing an order, you agree to these terms, together with any product-specific, promotion-specific or gift card terms displayed at the time of purchase. If you do not agree, please do not use the Website.
Our products and information
We aim to keep product names, descriptions, prices, images, availability, ingredients, allergen information and preparation instructions accurate and up to date. Product images are for illustration and may not show every detail of the supplied product.
Food information may change. Always read the label supplied with the product and follow its storage, use-by and preparation instructions. If you have a food allergy or intolerance, contact us before ordering and check the product label before consuming.
Orders and acceptance
When you submit an order, you are making an offer to purchase the selected products. An order is accepted when we send an order confirmation or otherwise confirm that it has been accepted.
We may refuse or cancel an order where a product is unavailable, a price or description contains an obvious error, delivery is not available to the address provided, payment is not authorised, or we reasonably suspect fraud or misuse. If we cancel an accepted order, we will provide any refund required for amounts already paid.
Customer information and accounts
You must provide information that is accurate, current and complete. If the Website allows customer accounts, you are responsible for keeping login details secure and for activity carried out through your account. Tell us promptly if you believe your account has been accessed without permission.
Prices and payment
Prices are shown in Australian dollars. Unless stated otherwise, prices include GST where applicable. Delivery charges and any other applicable charges will be shown before you complete checkout.
Payments are processed through Square. You authorise Square to process the amount shown at checkout. Square's terms and privacy practices may also apply.
Delivery
Delivery areas, charges, order minimums, cut-off times and other delivery information are set out in our Shipping & Delivery Policy. By placing an order, you agree to provide an address and contact details that enable delivery and to take reasonable steps to receive and refrigerate the products promptly.
Food handling and allergen information
You are responsible for checking the supplied label and following storage and preparation instructions. Refrigerated or frozen products must be stored promptly as directed. Do not consume a product if the packaging is damaged, the product appears unsafe, or the use-by date has passed.
We provide allergen information for our products, but recipes and ingredients may change. If you have a severe allergy, contact us before ordering. Do not rely solely on a general Website description; check the current product label and contact us if you need clarification.
Changes and cancellations
You may contact us to request a change or cancellation before an order is prepared, but we cannot guarantee that a request received after the applicable cut-off can be accepted. Because our products are perishable, an order may not be cancellable once it has been prepared or dispatched. This does not limit any rights you have under the Australian Consumer Law.
Returns and refunds
Our Returns & Refunds Policy explains how to report a damaged, incorrect, faulty or otherwise problematic product. Nothing in these terms excludes, restricts or modifies any consumer guarantee or other right that cannot lawfully be excluded under the Australian Consumer Law.
Gift cards and promotions
Gift cards are subject to our Gift Card Terms. Promotions, discount codes and special offers may have additional conditions, which will be shown before purchase. We will not apply a promotion where its stated conditions have not been met.
Reviews and user content
If you submit a review, image, comment or other content, you must have the right to submit it and it must be accurate, lawful and not misleading. We may moderate or remove content that is unlawful, abusive, irrelevant or otherwise inappropriate. We will not present reviews in a way that creates a misleading impression.
Website content and intellectual property
The Website and its content, including text, images, logos, recipes, designs and graphics, are owned by or licensed to Aston Lucas Gourmet. You may use the Website for personal, non-commercial purposes. You must not copy, reproduce, modify, publish, sell or exploit Website content without our written permission, except where the law allows.
Acceptable use
You must not use the Website to interfere with its operation, gain unauthorised access, introduce malicious code, scrape or harvest data, impersonate another person, or engage in unlawful, fraudulent or misleading activity.
Liability and consumer rights
We do not exclude or limit liability where doing so would be unlawful. Our products and services come with consumer guarantees under the Australian Consumer Law, and these terms are subject to those guarantees.
To the extent permitted by law, we are not responsible for loss caused solely by information supplied incorrectly by a customer, failure to follow storage or preparation instructions, or events outside our reasonable control. This clause does not remove any remedy available under the Australian Consumer Law.
Privacy
Our Privacy Policy explains how we collect, use and disclose personal information submitted through the Website.
Governing law
These terms are governed by the laws of Victoria, Australia. You and Aston Lucas Gourmet submit to the courts of Victoria and the applicable courts of appeal.
